Cancellation and Return Policy

1. Right of Withdrawal

The BUYER has the right to withdraw from the contract within 14 (fourteen) days from the date of delivery of the product purchased to them or to the person or entity specified by them for delivery, without giving any reason and without paying any penalty. In distance contracts concerning the sale of goods, this period begins upon the delivery of the product.

2. Exercising the Right of Withdrawal

To exercise the right of withdrawal, the BUYER must notify Gajah Mimarlık Dekorasyon San. Tic. Ltd. Şti. of their decision to withdraw in writing or via a permanent data storage medium within the 14-day period. The BUYER can send this notification via email. The consumer can use a standard form or exercise their right with an explicit statement of withdrawal.

3. Return Process When Right of Withdrawal Is Exercised

If the right of withdrawal is exercised:

a. The invoice for the product to be returned must also be sent with the product. If the invoice was issued in the name of a legal entity or merchant, a return invoice duly issued by the relevant person or company must also be presented for the return process to be completed.

b. If available, the return form must be filled out and sent with the product. However, the BUYER also reserves the right to make a separate statement of withdrawal apart from the return form.

c. The products to be returned must be sent complete, preferably with their original box, packaging, and if any, standard accessories and complementary parts.

4. Refund

The SELLER is obligated to refund the total amount collected, including delivery costs if any, to the BUYER within a maximum of 14 (fourteen) days from the date the withdrawal notification reaches them. This refund must be made without incurring additional costs or obligations for the consumer and in a manner appropriate to the payment instrument. The BUYER is also obligated to return the product within 10 (ten) days from the withdrawal notification; however, this period does not apply if the SELLER offers to retrieve the product themselves.

5. Depreciation and Liability

If the value of the product decreases due to a fault of the BUYER or if the return becomes impossible, the BUYER is obliged to compensate the SELLER for the damage in proportion to their fault. The right of withdrawal cannot be exercised in cases where the product is lost.

6. Returns for Promotional Orders

If, due to the exercise of the right of withdrawal, the order no longer meets the promotional conditions, the discount or advantage provided under the promotion may be cancelled. In this case, the amount of the discount provided under the promotion may be deducted from the amount to be refunded.

7. Cases Where the Right of Withdrawal Cannot Be Exercised

In accordance with Article 15 of the Distance Contracts Regulation, the right of withdrawal cannot be exercised in the following cases:

a) Goods or services whose price fluctuates depending on financial market fluctuations and are not under the control of the SELLER,

b) Products specially prepared in line with the BUYER's wishes or personal needs,

c) Perishable goods or goods whose expiration date may pass,

ç) Products whose packaging, tape, seal, or protective elements have been opened after delivery and are not suitable for return for health and hygiene reasons,

d) Goods that are mixed with other products after delivery and cannot be separated by their nature,

e) Books, digital content, and computer consumables if their packaging has been opened,

f) Periodical publications such as newspapers and magazines provided outside of a subscription contract,

g) Services related to accommodation, transportation, car rental, food and beverage supply, and leisure activities that must be provided on a specific date or period,

ğ) Services performed instantly in electronic environment or intangible goods delivered instantly,

h) Services whose performance has begun with the BUYER's consent before the expiration of the withdrawal period.

8. Custom-Made and Personalized Products

The right of withdrawal cannot be exercised for products specially produced according to the BUYER's request regarding size, color, fabric, leather, wood tone, lacquer color, module structure, or similar elements. Goods prepared in line with the consumer's wishes or personal needs are exempt from the right of withdrawal as per legislation.
